Felix Rojas, 44, was charged with rape nearly three weeks after he allegedly assaulted the body of the dead man on an R train near the Whitehall Street station, according to the NYPD.

At least one train’s black box had been disabled from 10:20 p.m. Saturday to 3:30 a.m. Sunday, police said.

In January of last year, a vacant R train was taken from the Forest Hills/71st Avenue station and driven onto train storage tracks. No one was injured. Commuters say someone could have been hurt.
